This general privacy policy (hereinafter ‘Privacy Policy’) governs the processing of your personal data by Teitu EMEA BV, Vrasenestraat 169, 9100 Sint-Niklaas, Belgium (with enterprise number BE0862.452.635) and Teitu BV, Rietstraat 64 b0201, 8000 Ostend, Belgium (with enterprise number B0882.930.424) (hereinafter ‘Teitu’, ‘Teitu People&Business Solutions’, ‘Teitu Recruitment Solutions’, ‘Teitu Career Counseling’, ‘E-Recruitment.be’, ‘we’, ‘us’, ‘our’) in the context of your visit to our websites or your communication with us through our websites, job application, email, correspondence, telephone, fax, and social media.

By agreeing to this Privacy Policy, you give us approval to process your personal data in accordance with the provisions in this policy, as outlined below.

Your personal data is processed by Teitu.

We reserve the right to amend the Privacy Policy at our discretion and at any time. You will be notified of such changes via our websites. If you do not agree to these changes, you must notify us by sending an email to privacy@teitu.be. If we do not receive such an email within three (3) working days after announcing the changes to the Privacy Policy on our websites, it will be assumed that you unequivocally accept the changes.

2. Types of Personal Data Processed by Us

When you use our websites, we collect:

  • Technical information regarding the device you use, such as your IP address, browser type, geographic location, and operating system; and
  • Information about your browsing behavior, such as the time you spend on a page, which links you click, which pages you visit, and how often you visit a particular page.

When you fill out a contact form on our websites or contact us via email, mail, phone, fax, or a social medium, we collect:

  • The identity information you provide to us, such as your name, email address, mailing address, phone number, employer, and position;
  • The content of the message and its technical details (with whom you communicate at our end, the date, the time, etc.); and

When you apply for a job vacancy via our websites or in any other way, we request your consent for processing your personal data. To enable us to assist you in finding a suitable job, we collect your personal data through your CV and registration process. Such data includes, but is not limited to:

  • The identity information you provide to us, such as your name, email address, mailing address, phone number, employer, and position;
  • Your availabilities and information (e.g., idea day/hour fee) as a freelancer (only for freelance assignments);
  • Your past career; and
  • Any other personal data you provide to us.

When you, as a company, ask us to collaborate, we keep information about you. This information includes, but is not limited to:

  • The contact details you provide to us, such as a name, email address, mailing address, and phone number;
  • Your job title;
  • Your company;
  • The content of the message and its technical details (with whom you communicate at our end, the date, the time, etc.); and
  • Any other personal data you provide to us.

When you request or provide information regarding career guidance or coaching via our websites or in any other way, we request your consent to process your personal data. To enable us to assist you in providing the necessary information in this regard, we collect your personal data through your CV and registration process. Such data includes, but is not limited to:

  • The identity information you provide to us, such as your name, email address, mailing address, phone number, employer, and position;
  • Your past career; and
  • Any other personal data you provide to us.

3. Purposes for which we process your personal data

3.1 

We process your personal data to provide you with the requested information, products, and services in a personalized and efficient manner.

When you are looking for a job, we process your personal data to:

  • Assist you in finding a suitable job/freelance assignment;
  • Communicate with you about open positions and the progress of any applications;
  • Provide your data to suitable future employers, provided that you have given us specific consent for this;
  • Send you notifications about open positions we believe may interest you;
  • Assist and advise you during your job search;
  • Provide you with information about general trends in the job market;
  • Inform you about potential opportunities for career guidance or coaching;
  • Request feedback on our services; and
  • Fulfill our obligations to our clients when you are offered a job.

3.3 

If you ask us to collaborate as an employer, we process your personal data to:

  • Provide you with the requested services;
  • Provide you with reports on the work we perform for you;
  • Provide advice on relevant services and products;
  • Provide you with information about general trends in the job market; and
  • Request feedback on our services.

3.4 

For processing personal data of commercial contacts (customers + prospects), we rely on the necessity of such processing for the execution of a contract or the preparation thereof, to comply with the legal obligations incumbent upon us (such as for our business management, accounting, invoicing), and for the pursuit of our legitimate interests related to our business management, customer relationship management, and prospects.

Additionally, we process your personal data to comply with legal obligations or to respond to any reasonable requests from competent law enforcement or government agencies, the judiciary, and governmental or regulatory bodies, including competent data protection authorities. Your personal data may be transferred to law enforcement or judicial authorities as evidence, either at our initiative or if there are reasonable suspicions of an unlawful act or crime committed by you in the context of your registration via or use of our website or any other communication with us.

We process your personal data to conduct statistical analyses with the aim of improving our websites, products, and services or developing new products and services.

We process your personal data to safeguard our legitimate interests and the legitimate interests of our partners or third parties when your registration via or use of our website or other communication channels may be considered as (a) breach of any applicable terms of use, intellectual property rights, or any other rights of a third party, (b) a threat to the security or integrity of our websites or other communication channels, (c) a threat to the website, other communication channels, or underlying systems of our subcontractors due to viruses, Trojan horses, spyware, malware, or any other form of malicious code, or (d) hate speech, obscene, discriminatory, racist, defamatory, retaliatory, offensive, or otherwise inappropriate or illegal.

4. Legal Basis for Processing Your Personal Data

As the data controller, we ask for your consent, where necessary, to process your personal data in accordance with the terms described in this Privacy Policy.

4.2

To comply with our legal obligations, the processing of your personal data for the purposes mentioned in section 3.4 is necessary.

4.3

To comply with our legal obligations, the processing of your personal data for the purposes outlined in paragraphs 3.4, 3.5, and 3.6 is necessary.

5. Parties to Whom We Disclose Your Data

5.1 

We do not disclose your personal data in an identifiable manner to third parties, except as mentioned in section 3 and in this section 5, and unless you have provided us with your consent for this purpose.

5.2 

We rely on third parties to provide you with our websites and services and to process your personal data on our behalf. For example, we collaborate with reliable third parties to conduct research and provide email services. When you are looking for a job, we may work with third parties who perform tasks on our behalf, such as verifying references, certificates, and criminal records, conducting psychometric evaluations, and testing skills. These third parties may only process your personal data on our behalf and with our express written consent to meet the conditions set out in section 3.

We guarantee that all third-party processors are carefully selected and obligated to safeguard the security and integrity of your personal data.

5.3 

When required by law, we will disclose your personal data to regulatory authorities or law enforcement agencies.

6. Location and transfer

6.1 

We primarily process your personal data within the European Union and the European Economic Area. However, to process your personal data for the purposes described in section 3 of this Privacy Policy, we may transfer your personal data to other Teitu offices or to third parties located outside the EEA. Any entity outside the EEA that processes your personal data is required to take necessary measures to protect it. Such measures stem from:

Applicable legislation in the respective country that is considered equivalent to the protection provided within the EEA; or

A contractual agreement between us and the respective entity.
We primarily process your personal data within the European Union and the European Economic Area. However, in order to process your personal data for the purposes described in section 3 of this Privacy Policy, it may be necessary for us to transfer your personal data to other offices of Teitu or to third parties located outside the EEA for processing.

7. Quality Assurance

7.1 

We strive to process only the personal data necessary to achieve the purposes described in section 3 of this Privacy Policy.

7.2 

Within 24 hours of processing your personal data, you will be asked via email for consent to retain your personal data in our database. If you do not consent, your personal data will be deleted no later than thirty (30) days after receipt of this request. If you consent, your personal data will be retained for a period of 3 years to fulfill the purposes described in paragraph 3 of this Privacy Policy, or until you withdraw your consent for processing.

7.3 

Upon receiving consent to retain your personal data, we assume that you are (potentially) seeking employment. The retention period of personal data is set at three years, as the average Belgian employee in the domains where Teitu is active remains employed with the same employer for three years according to various sources.

Before the expiration of the 3-year retention period, you will once again be asked via email for consent to retain your personal data in our database, and the process described in paragraph 7.2 will be in effect again.

7.4 

Your personal data will not be processed for longer than necessary to achieve the purposes described in section 3 of this Privacy Policy, or until you withdraw your consent for its processing. However, please note that withdrawing your consent may result in you no longer having access to part or all of our websites and/or other communication channels. We will anonymize your personal data when they are no longer necessary for the purposes described in section 3 of this Privacy Policy, unless:

  • There is a higher interest for Teitu or any other third party to keep the personal data identifiable; and
  • We are legally, regulatory, judicial, or administratively obligated not to anonymize the data.

7.5 

We will take the necessary technical and organizational measures to safeguard your personal data against unauthorized access, improper use, unauthorized disclosure, unauthorized alteration, and theft, as well as accidental loss, manipulation, or destruction. Only employees or third-party processors who need to be aware of your personal data can access them. Moreover, they are bound by strict confidentiality rules. However, you understand that, while we take all measures to safeguard your data, its security and protection can never be absolutely guaranteed.

8. Your rights

8.1 

You have the right to request access to all your personal data processed by us. If permitted by law, we may refuse your request, in which case we will inform you of the reason for this refusal. We reserve the right to charge an administrative fee if access is repeatedly requested with the clear intention of causing inconvenience or harm to us.

8.2
You have the right to request the correction of any inaccurate personal data about you, free of charge. If such a request is submitted, it must be accompanied by evidence that the data to be corrected are indeed incorrect.

8.3
You have the right at any time to withdraw your previously given consent to the processing of your personal data or to adjust your communication preferences.

8.4
You have the right to request the erasure of your personal data if they are no longer necessary for the purposes described in section 3 of this Privacy Policy, or if you withdraw your consent for their processing. However, such a request for deletion by us will be evaluated considering:

  • Higher interests of Teitu or any third party; and
  • Legal, regulatory, or judicial obligations, or administrative orders contradicting such deletion.

Instead of requesting the erasure of your personal data, you can also ask us to restrict their processing when (a) you contest the accuracy of the data, (b) their processing is unlawful, or (c) the data are no longer needed for the purposes described in section 3.

8.5 

You have the right to request us to provide you with all personal data you have provided to us in a structured, commonly used, and machine-readable format.

8.6 

If you wish to exercise any of the rights mentioned above, you can do so by sending an email to privacy@teitu.be. An email requesting a specific right cannot be interpreted as consent for the processing of your personal data, except to the extent necessary to process your request. Such a request must clearly state which right you wish to exercise and, if necessary, the reason for it. The request must be dated, signed, and accompanied by a digital scan of your valid identity card as proof of your identity. If you use the contact form, we may ask you for a signed confirmation and an identity document. We will immediately acknowledge receipt of your request. If the request is valid, we will fulfill it as soon as reasonably possible, no later than thirty (30) days after receiving it.
